From Lost in Bureaucracy to Found by Katrina Eagle, My Expanded Family
"I will begin my testimonial with a brief summary of my case for those who may read this: I enlisted in the Army the fourth of July 1967. I completed my basic training in Ft Bliss TX, and continued my AIT in Aberdeen proving grounds MD. I completed my training, my MOS was 44C20 welder before receiving orders to VN and arrived in country around January 20th, 1968. As I later found out, I was just in time for the Tet offensive and was stationed at Camp Granite in Qui Nhon where I ran a body shop in a motor pool supporting 700 tactical and commercial vehicles. I completed my tour in VN and went back to the world around January 20th, 1969. I was deployed to Ft Belvoir, VA where I ultimately taught welding. I was ordered TDY to Blackstone VA and drove a deuce and a half around a 30-mile course, testing the use of radial tires to replace all terrain tires. While stationed there I was in an accident in line of duty and broke my back. While finishing my military tour, I had a physical profile that carried me through until my discharge on the fourth of July in 1970. While completing my end of enlistment paperwork, I filed paperwork for a disability claim for my broken back. Honestly not thinking much about it. However, I never received any notice of adjudication on my claim. I got jobs in construction and in 1983 I wrote to the VA asking if I could receive any help being retrained because construction was aggravating my damaged back. Around 2016 I pursued my claim that the VA had never responded to. Through a miracle I was introduced to Katrina Eagle Esq. As you can see, much time had passed since I was in the Army. I fully expected my claim to be lost in that time. Katrina reviewed my situation and while building no expectation of any outcome with the VA, she methodically investigated my case, including knowledge about how the laws had been updated since the time I had been discharged from the army. Can you imagine how easily the VA could claim no fault? And I would have been another statistic of being lost in the bureaucracy. "Serving in the US Navy from January 23, 1967 until October 17, 1970. I was stationed aboard the USS Ticonderoga CVA-14 from April 29, 1967 until October 17, 1970. During this time the Ticonderoga served in three cruises to the Western Pacific including the Tonkin Gulf of Vietnam. I initially filed a medical benefits claim with the Veterans Administration on 8/1/2002 for diabetes, hearing loss, and stress. Over the next 19 years (until 5/3/2021) my claims were repeatedly denied. On 5/3/2021 the VA gave me a rating of 20% for the hearing loss and the stress (PTSD), but denied the claim for diabetes. The reasoning for the denial was “No Boots on the Ground” and the ship did not enter territorial waters. In an appeal that I submitted on 10/18/2003, I went on record that the ship served 3 miles off the DaNang coastline. This was during the siege of Khe Sanh in April 1968. On 5/3/2021 I contacted Eagle Law and discussed my case with Katrina Eagle. She mentioned that I had a “righteous case” and agreed to represent me. I had previously documented the ships position verifying that we operated within the 12 mile territorial zone on April 1, 1968 (as submitted back on 10/18/2003). I used the 4/1/1968 ships log which included the speed of the ship, the course heading of the ship, and the time that the ship held this course. Using these documented calculations, we confirmed that the ship entered territorial waters. The VA initially approved, then denied the appeal as they stated that they did not have anyone on staff with the expertise to confirm these calculations. Katrina Eagle then argued that the Veterans Administration had the responsibility to seek expertise and not deny the veteran his earned benefits. The VA sent the case to the Navy Review Board in Washington DC and a judge was assigned to resolve the case. The Navy confirmed our calculations (not the VA) and eventually on March 23, 2022 a 40% rating was awarded. This is after almost 20 years of repeated denials. On 9/27/2023 having heart issues, I had open heart surgery, lungs drained, and a pacemaker installed. Katrina Eagle, once again, filed a new claim for me 6/29/2024 and on 10/9/2024 the claim was granted. My disability rating increased to 100%. Katrina was very proactive in representing me and extremely knowledgeable in dealing with the Veterans Administration. If I had known, I would have contacted Katrina years earlier saving me the frustrations of the repeated denials. Katrina got me the results that I was seeking for years, and could not get with my own efforts. I was dealing directly with VSO’s and ultimately the VA. It was a continual run around. I would recommend Katrina Eagle to represent any veteran that is not receiving the proper attention from the Veterans Administration in handling their medical claims."

"Beginning February 2021 (three months after my husband passed from cholangiocarcinoma), I began the process of filing for DIC following the VA website guide. Several denials later, in December 2022, I learned about Katrina Eagle. I submitted the online information form on her website. Within 48 hours, she called me and we spent nearly an hour reviewing Jim's case. From that call and going forward, I felt such a sense of calm. "I served in the military from 1968 to 1972 which included two Vietnam tours. I started experiencing medical issues not long after I was discharged in 1972. Frankly, I did not even consider going to VA for my medical issues nor did I think VA would allow scheduling doctor visits. I paid cash for my appointments, treatments and medicines. It wasn't until 1980 that I was in a position to obtain medical insurance through my employer. Fast forward thirty years, in 2010, after my premiums got unaffordable. At that time, I was told the VA would extend health care for Vietnam era veterans. I made an appointment with the VSO in my county and was quickly placed in the VA healthcare system. At the same time the VSO and I filled out forms for VA disability compensation for an extensive list of medical issues I was experiencing since my discharge. In hindsight, I should have involved the VA from the beginning so that I would have had an earlier trail of my medical conditions recorded with VA. My claim was denied in 2010 and several more attempts with additional backup, pictures, and buddy letters which failed to approve my appeal. I decided to give up on the process. I was convinced my paperwork with all my supporting documents would fill in the gaps VA needed. I was devastated and beaten. I don't remember how I got the name of Katrina Eagle of the Veterans Law Office. I think it was 2017 when I made the 'Hail Mary' call and got a recording that I would be contacted the next day. BANG! The returned call from Katrina. She spent time listening to my story and requested I send her office all my correspondence and denials. She would review my file and call me back and she did. Katrina unraveled my correspondence and gave me expectations based on the status of my claim. Saved From the Error Prone VA Bureaucracy
"I served in the infantry in Vietnam and Cambodia in 1970. My area of operation had been heavily treated with Agent Orange. Later in September 2021 I had been diagnosed with Active Myeloma. I submitted a claim twice to VA for a disability. Each time the VA made errors in the facts and concluded that there was no link between my condition and my service in Vietnam, denying both claims. "You Have a Case!" Those were the first words I heard from Atty. Eagle! And only through her hard work, legal acumen and expertise was I able to be approved for a VA disability. "I am a Blue Water Navy Vietnam Veteran. I filed my claim, and was approved, at 100% P&T. For that, I had another attorney as my representative, but she had nothing to do with my case... more on that, to come. Something did not sit right with me, about the effective date of my claim. I questioned my attorney, and she said, since I was rated 100%, there was nothing to be done... not true. I learned of Katrina Eagle & Jim Radogna through the BWNVVA... " I served 4 years in the Air Force and was stationed in Thailand, with TDYs in Vietnam during 1972-3. As a crew chief, I was exposed to hazardous chemicals, fuels, and agent orange working on the flight line, close to the perimeter. As a result of my service, I was diagnosed with a chronic lung disease and inoperable tumors affecting my kidneys. For 8 years I applied for compensation and was denied again and again. Korean War Veteran Approved For 100% Disability
"I served in the army from 1954 to 1956, at the end of the Korean War. I was not aware of the possible benefits of PTSD and hearing loss that I had lived with until 2017. I found out that a veteran doesn't have to be involved in overseas combat to qualify for full benefits, if the facts can be provided to the right personnel. I was on guard duty while in basic training carrying an unloaded rifle and a flashlight. I heard screaming coming from a two man tent and found our Master sergeant hitting a fellow soldier with a 2X4. No cell phones back then, so I called for help as I battled the sergeant using my rifle like a baseball bat. Help finally arrived, but too late to save my friends life. Three months later our cannon and crew was sent to Louisiana for two weeks of night training. Regulations were found later that every heavy duty vehicle using their small slits of head lights must have two other soldiers walk ahead of them with large flash lights for safety. A tank ran over a two man tent near our cannon and killed two fellow soldiers. Further investigations found most operators of all heavy duty vehicles were not trained or qualified to drive those units. After three days our crew was sent back to South Carolina for regular duty. For three years after 2017, I was denied 100% benefits three different times because the approval team could not find any proof of either event. In less than a year, Katrina produced evidence that a congressional investigation in 1973 found that many commanding officers who had any serious accidents or deaths during my years of service, never filed any reports on those, or when they transferred to a higher position, destroyed all evidence so their commands had no adverse events that might hinder their promotions. During those years, not every soldier had a cell phone to record those types of accidents. She also presented proof that a large fire at the army archives in the mid 70's destroyed 18,000,000 service records of those who served before 1960, and no copies were ever printed. She then presented these reasons there were no records of these events in my service file. With all the legal language at her disposal, I was approved for 100% disability."

"As a Vietnam veteran and having been exposed to Agent Orange in Thailand during my tour in 1972, I developed ischemic heart disease as well as hearing loss associated with being a fighter crew chief, RF-4C aircraft. "I was working with the local Veterans Affairs in my county for months and months and I was getting nowhere. My husband died of colon cancer in 2014. Do Not Wait a Second Longer
"It is my pleasure to write a few words about my experience with Katrina Eagle, relative to a VA claim upon which she represented me. I am a Vietnam vet and I submitted a claim for an Agent Orange related disease that was not fully recognized by the VA. In fact, I was rejected by the VA on a couple of previous occasions. Out of frustration and despair over five years of trying, I took one final action in seeking Katrina's help before I quit altogether.
